Vino.com Fidelity Program Terms and Conditions

1. Object

These general terms and conditions (hereinafter referred to as the “General Terms and Conditions”) govern the terms and conditions for participation by users of the Website (the “Customers” or the “Customer”) in the Fidelity Program offered by Vino.com (hereinafter referred to as the “Program”), as well as the terms and conditions for the use of the virtual Fidelity Card assigned to Customers in the context of the Program (hereinafter referred to as the “Card”) and the services and features ancillary to the Card (hereinafter collectively referred to as the “Service”). In the General Terms and Conditions, any term with a capital letter not expressly defined herein shall have the meaning attributed to it in Vino.com’s Terms of Use.
The Card, usable through the Website, allows Customers to earn Fidelity Points based on purchases completed on the Website. These Points can be used to obtain discounts on certain products available on the Website (hereinafter referred to as “Points”).

2. Program Enrolment

Program enrolment is automatic and occurs upon the creation of an Account on the Website, after accepting these General Terms and Conditions and completing the first product purchase on the Website, without prejudice to the provisions of Article 4 below.
The Program and the Services are offered by Vino.com free of charge for all orders placed by Customers on the Site, with the exception of those destined for one of the countries listed below, for which the Program and the Services will not apply: Netherlands.

3. Personal Area

The Customer has access to a personal area (hereinafter referred to as the “Personal Area”) accessible via the Website or the dedicated app (hereinafter referred to as the “App”). Through the Personal Area, the Customer can view the Points balance on their Card, which are assigned based on transactions made on the Website, and check the thresholds reached for obtaining discounts by redeeming Points at the time of purchase on the Website.
Regarding the use of the Personal Area, the Customer agrees to: - Keep login credentials and passwords for their Personal Area separate, stored in appropriate places, and handle them with the utmost care. These credentials must never be disclosed or granted to third parties under any circumstances. It is understood that the Customer will be held liable for any use of the Service carried out through the Personal Area by third parties who have been provided with the login credentials. - Not allow third parties to access or use the Service in any way. - Indemnify and hold Vino.com harmless from any liability arising from unlawful use of the Service, regardless of who conducts it, as well as from any claims, demands, charges, and/or actions brought by any party related to damages, losses, expenses, and/or amounts claimed for any reason resulting from the unlawful use of the Service, including login credentials.

4. Program Features and Operations

Following enrollment in the Program, the Customer will have access to the Card. Points, accumulated based on purchases made on the Website, grant the right - upon reaching specific thresholds - to discounts on the total value of products available on the Website. Points will be accumulated according to the criteria specified below, calculated based on the currency used:

  • For every euro spent you earn 10 Fidelity Points
  • For every pound spent you earn 10 Fidelity Points
  • For every 10 Danish crowns spent you earn 10 Fidelity Points
  • For every 10 Swedish crowns spent you earn 10 Fidelity Points
  • For every Swiss franc spent you earn 10 Fidelity Points

  • The Customer can view their Card and the amount of Points available by accessing the Personal Area through the Website or App. Points earned can be redeemed starting on the 15th day after the purchase of a Product, provided the order has not been canceled and/or annulled by the User and/or Vino.com.
    The purchase of certain products marked with the “Bonus Points” icon grants higher Points accumulation than outlined in Article 4.
    Similarly, subscribing to the Vino.com newsletter or participating in promotions or events organized by Vino.com may grant additional Points, as specified by Vino.com.
    Points will have a minimum validity of one year and will expire on the first recurring date among the following: January 31 and July 31 of each year. If Points are not used within their validity period, they will automatically expire and can no longer be redeemed.
    The Customer remains solely responsible for the use of the Card and Points, which cannot, under any circumstances, be transferred to other Accounts, even if linked.
    The Customer acknowledges and agrees that in the event of Account deletion, they will no longer be able to participate in the Program, and all Points accumulated on the Card will become non-redeemable.

    5. Limitation of Liability of Vino.com

    Except in cases of willful misconduct or gross negligence, Vino.com shall not be liable for any direct or indirect damages incurred by the Customer in connection with any event related to the use of the Card, their Account, or the Service in general. Direct or indirect damages include, but are not limited to, loss of profit, business interruption, or loss of earnings.

    6. Personal Data Processing

    The Customer’s personal data will be processed in compliance with applicable laws and based on the Privacy Policy accessible in the Privacy section of the Website or by clicking here.

    7. Amendments to the General Terms and Conditions

    Vino.com reserves the right to make changes to these General Terms and Conditions at any time for justified reasons, such as Service development, changes in technical and commercial costs incurred for Service provision, changes in the competitive landscape impacting the commercial offer, as well as due to technical or management needs or amendments to applicable laws.
    Changes will be communicated to the Customer at least 30 days before the date of their application via the email address provided during Account registration or subsequently communicated.
    It is understood that mandatory regulatory provisions that imply changes or integrations to the General Terms and Conditions will automatically and lawfully be incorporated into them.
    Vino.com also reserves the right to introduce, at any time, additions to these General Terms and Conditions in case of new Service features, Card updates, Program enhancements, and/or new usage methods, provided they do not alter the essential nature and characteristics of the Service.
